Facts:
Norfolk Southern railroad employee Benjamin Davis was injured in a truck accident. He was a passenger when the driver of the truck ran off the road and crashed into a tree. Our client suffered a serious back injury that prevented him from returning to work. The defendant railroad conducted surveillance of our client and investigated his unsuccessful efforts to obtain work by interviewing the potential employers where our client had submitted an application.
